Terms of Use

These Terms of Use (“Terms”) govern your use of the Pouched app and website. By downloading or using Pouched, you agree to them. If you don't agree, please don't use the app.

1. What Pouched is, and isn't

2. Eligibility

You must be at least 17 years old, and old enough under the law where you live to buy nicotine products, to use Pouched.

3. Ask Pouched (AI coach)

Ask Pouched gives automatically generated suggestions. Replies may be incomplete, inaccurate or unsuitable for you. Don't rely on them as professional advice. Don't use Ask Pouched to try to obtain harmful content or to misuse the service. Fair-use limits apply to the number of messages per day. How your messages are handled is explained in our Privacy Policy.

4. Pouched Pro, subscriptions and payments

• Core tracking is free. Pouched Pro unlocks extra features and is offered as an auto-renewing weekly or annual subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy.
• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Subscriptions renew automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• If a free trial is offered, any unused part of it ends when you buy a subscription. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you're charged.
• Manage or cancel any time: on iPhone in Settings → your name → Subscriptions, and on Android in Google Play → Profile → Payments & subscriptions → Subscriptions. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies. We can't issue refunds directly.
• Use Restore a purchase in Settings to get Pro back on a new device signed in to the same store account.

5. Your data

Your tracking data is stored on your device and is your responsibility to back up. If you delete the app or reset it without a backup, the data can't be recovered.

6. Acceptable use

Don't reverse-engineer, resell or interfere with the app or its servers, try to bypass payments or usage limits, or use Pouched for anything unlawful.

7. Intellectual property

Pouched, its design, text, graphics and code belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for your own non-commercial use under these Terms. Product names mentioned in the app belong to their owners. Pouched isn't affiliated with or endorsed by any nicotine brand.

8. Disclaimers and liability

Pouched is provided “as is” and “as available”, without warranties of any kind to the extent the law allows. We don't promise that the app will help you quit or reduce nicotine use, or that it will be uninterrupted or error-free. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages. Our total liability for any claim is limited to the amount you paid for Pouched in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer law that can't be excluded.

9. App store terms

If you downloaded Pouched from the Apple App Store, Apple's Standard Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, the Google Play Terms of Service also apply. Apple and Google are not responsible for the app or its support.

10. Changes and ending

We may update these Terms. The date at the top shows when they last changed, and continuing to use the app means you accept the update. You can stop using Pouched at any time. We may suspend access to online features, such as Ask Pouched, if you break these Terms.
